Important Legislative Update
May 17 -- California legislation AB 356 (2005) amends the California Labor Code and imposes new disclosure requirements on employers. Effective July 1, 2006, employers will be required to add the following statutory language to the continuation coverage and COBRA notifications they send to their employees, former employees, members, spouses/domestic partners or former spouses/domestic partners:

"Please examine your options carefully before declining this coverage. You should be aware that companies selling individual health insurance typically require a review of your medical history that could result in a higher premium or you could be denied coverage entirely."

AB 356 also imposes similar requirements on health plan and insurer communications to members and insureds. As of July 1, 2006, all affected Health Net documents - Summary of Benefits, Evidence of Coverage, Certificate of Insurance, etc. - will include this new language in the continuation coverage and COBRA rights sections.
